1. Introduction

 

Welcome to SafeHer!

 

These are our Terms and Conditions (“Terms”), which govern your access to and use of the SafeHer mobile application (“App”) and related services (collectively, the “Services”). By downloading, accessing or using SafeHer, you agree to comply with and be bound by these terms. If you do not agree with these Terms, please do not use the App.

 

SafeHer is designed to put digital safety in the hands of women and girls by preventing online abuse before it escalates. This is achieved through a secure, anonymous reporting platform that connects users to legal support, mental health resources and digital safety tools. Our goal is to create a safer online environment where every user can feel protected, supported and empowered.

 

Please read these Terms carefully, as they explain your rights, responsibilities and the conditions under which you may use SafeHer.

 

 

2. Registration of account

 

2.1 Account creation

 

To access certain features of the App, you may be required to create an account (“Account”). When registering, you agree to provide accurate, current and complete information as prompted on the sign-in page.

 

You are responsible for maintaining the confidentiality of your login credentials and for all the activities that occur under your account. By registering on the App, you agree that:

 

i.  your account and password are personal to you and may not be used by anyone else to access the App.

ii. you will not create accounts for the purpose of abusing the functionality of the App, or its users; nor will you seek to pass yourself as another user.

 

2.2 Termination of account

 

If you no longer wish to have a registered account, you may terminate your account by logging into your account settings and selecting the ‘delete account’ hyperlink.

 

We may terminate your registered account, at our sole discretion, by emailing you at the address you have registered, stating that your account has been terminated.

 

 

3. User content

 

SafeHer allows its users to submit, post or share information through the App, which includes reports, messages, feedback or even other materials (“User Content”).  By submitting User Content, you retain ownership of your information, but grant SafeHer a limited, non-exclusive, revocable license to use it only as necessary to operate, improve, and provide SafeHer’s Services, in line with our commitment to privacy and confidentiality.

 

By using this App, you agree that:

(a)      you are solely responsible for the content you submit through the App

(b)     you will not post or share any content that is false, misleading, defamatory, abusive, threatening, invasive of another person’s privacy, or otherwise unlawful

(c)      you will not upload any content that infringes on the rights of any third party, including intellectual property, privacy, or confidentiality rights

(d)     you will not use the App to harass, harm, or impersonate another person

(e)      the views expressed by you and other users in that content do not necessarily reflect the views of SOW-Kenya or SafeHer

(f)       we have no obligation to pre-screen, monitor, review, or edit any content posted by you and other users of the App.

 

SafeHer reserves the right (but is not obligated) to review, remove, or restrict access to any User Content that violates these Terms or applicable laws, or that we may believe may endanger the safety of other users.

 

Due to the sensitive nature of the User Content we expect to receive in relation to online abuse or safety incidents, we will handle such information with strict confidentiality, in accordance with our Privacy Policy and applicable data protection laws.

 

4. Use of material appearing on SafeHer

 

SafeHer is provided to you by SOW-Kenya for personal, non-commercial use, solely for the purpose of promoting digital safety and providing access to reporting tools, legal support, mental health resources and other related services.

 

All intellectual property rights in and to the App, including its design, features, software, databases, logos and content, are owned by or licensed by SOW-Kenya, as well as all text, images, graphics, logos, audio, video, URLs, metadata and other material appearing on the App. By using the App, you are granted a limited, non-exclusive, non-transferable and revocable license to download, access and use the App in accordance with these Terms.

 

You agree not to:

(a)      copy, modify, reverse-engineer, decompile, or attempt to extract the source code of the App.

(b)     use the App for any unlawful, harmful or fraudulent activity

(c)      interfere with or disrupt the operation of the app or its servers and networks connected to it

(d)     use the App in any way that could damage, disable or impair its functionality or compromise the safety of other users.

 

SafeHer reserves the right to update, modify or discontinue the App(in whole or in part) at any time to improve performance, security or functionality. Where possible, users will be informed in advance of any significant changes that may affect their access or use.

 

5. Data Protection

 

SafeHer is committed to protecting your privacy and ensuring that your personal data is handled safely, lawfully and transparently. We collect and process personal information only as necessary to operate and improve the App. All personal data collected through the App is processed in accordance with the Kenya Data Protection Act, 2019 and other applicable data protection laws.

 

We will ensure that:

(a)      Personal data is collected only for specific, legitimate purposes and is not used in any manner incompatible with those purposes

(b)     Your data is stored securely and protected against unauthorised access, loss, misuse or disclosure

(c)      Anonymous and aggregated data is used for research, reporting or service improvement so as not to identify any individual user.

(d)     Users have the right to access, correct or request deletion of their personal data in accordance with the Data Protection Act.

6. Right to make changes to the agreement

 

Please note that we may change these terms and conditions from time to time at our sole discretion, and we reserve the right to do so without your consent. Please ensure that you review these terms and conditions regularly, as you will be deemed to have accepted the variation if you continue to use the App after the changes have been posted

 

7. User guidelines (rules, restrictions, requirements)

 

We are committed to creating a safe, respectful and supportive digital space for women and girls, and to maintain this environment, all users are expected to use the App responsibly and in accordance with these Terms and applicable laws.

 

When using the App, you agree to:

(a)      Use the app only for its intended purpose which is to report incidents, access safety tools and connect with legal or mental health support

(b)     Provide truthful, accurate and relevant information when submitting reports or feedback

(c)      Treat other users and SafeHer partners with respect and dignity

(d)     Keep your login details secure and confidential

 

SafeHer reserves the right to suspend, restrict or terminate any account that violates these guidelines or poses a risk to the safety and integrity of the platform.

 

8. Governing law

 

These Terms and any disputes or claims arising out of or in connection with the use of the SafeHer App shall be governed by and construed in accordance with the laws of Kenya. The parties shall seek to resolve disputes amicably, and where this is not possible, the matter shall be referred to arbitration in accordance with the Arbitration Act (Cap. 49 Laws of Kenya), before resorting to litigation.

 

9. Warranty disclaimer

 

The App and all related services are provided on an “as is” and “as available” basis; therefore, it makes no warranties or representations, express or implied, regarding the operation, reliability, availability or suitability of the App or its content for any particular purpose.

 

While we strive to ensure that the platform is safe, accessible and accurate, we do not guarantee that:

(a)      The app will always function without interruption, delay or errors

(b)     All reports or incidents submitted through the App will lead to specific legal or support outcomes

(c)      The app or its servers are completely free of viruses or other harmful components.

 

SafeHer disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. The App is designed as a support and reporting tool and should not replace direct contact with law enforcement, emergency services and or licensed professionals where urgent assistance is required. Users are encouraged to seek immediate help in cases of emergency.

 

10. Limitation of liability

 

To the fullest extent permitted by applicable law, SafeHer, its founders, employees, partners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your use of the App or the Services. This includes, but is not limited to, damages for loss of data, emotional distress, service interruptions, device damage, or any other losses, even if SafHer has been advised of the possibility of such damages.

 

While our platform is designed to promote safety and access to support resources, SafeHer does not control the actions or outcomes of third parties such as legal service providers, counsellors or emergency responders connected through the App. SafeHer is not responsible for the accuracy, reliability or conduct of any third-party service or information accessible through the platform.

 

Your use of the SafeHer App is at your own discretion and risk, and you are solely responsible for any consequences resulting from its use.

 

11. Indemnification

 

By using the SafeHer App, you agree to indemnify, defend and hold harmless SafeHer, its founders, employees, partners and affiliates from and against all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to:

(a)      Your violation of these terms

(b)     Your misuse of the App or services

(c)      Any content or information you submit, post or share through the App

(d)     Your violation of any law or the rights of a third party.

 

Should your actions cause harm, loss or legal claims against SafeHer, you will be responsible for covering the related costs and the cost of defending SafeHer from those claims. SafeHer reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate fully with such defence.

 

12. No waiver

 

Failure or delay by SafeHer to enforce any right, provision or remedy under these Terms shall not constitute a waiver of that right or provision. Any waiver of a provision of these Terms will only be effective if it is made in writing and signed or formally approved by SafeHer.
